Lead, plan, and execute litigation strategies for overdue and defaulted accounts, including Non-Performing Loans (NPL) and Written-Off (WO) accounts. Oversee the entire litigation process, from issuing Notices of Demand (NOD) through to Judgment/Execution, including Bankruptcy proceedings.
Supervise and mentor a team to ensure all litigation actions are executed efficiently and within established timelines. Provide ongoing guidance and ensure all staff adhere to procedural requirements.
Monitor and maintain regular communication with the bank's panel of solicitors, ensuring timely updates and status reports on ongoing litigation cases. Act as the key point of contact for solicitors to ensure smooth execution of legal actions.
Oversee all collection, recovery, and litigation activities related to guarantee schemes (e.g., CGC, SJKP, SJPP, Cagamas). Manage NPL claims submissions, process remittance of collection proceeds, and prepare detailed NPL reports for guarantee scheme providers (GSPs).
Evaluate, empanel, and manage the department's panel of litigation solicitors. Ensure that all solicitors meet performance standards and oversee the process for the termination or replacement of underperforming solicitors. Conduct regular performance reviews and maintain relationships with solicitors through periodic meetings to address litigation performance, challenges, and opportunities.
Ensure the division adheres to all relevant internal and external regulations, including BSN policies, Bank Negara Malaysia guidelines, and applicable laws (e.g., National Land Code, Insolvency Act, Financial Services Act). Ensure compliance with specific guidelines related to financing, write-offs, property auctions, and litigation procedures.
Ensure that all legal actions align with regulatory standards and protect the bank's interests while mitigating potential risks. Proactively monitor changes in regulatory frameworks and adjust processes accordingly.
Job Requirements
Bachelor's Degree in Business Management, Law or a related discipline.
At least 3 years of hands-on experience in a relevant field with a proven track record in legal, financing or recovery operations.
Certified in Design Thinking or completion of a recognized Design Thinking program.
In-depth knowledge of legal, financing and/or recovery processes, with the ability to apply this expertise in practical scenarios.
Strong foundational understanding of Banking and Finance principles, including regulatory frameworks and industry best practices
